So this week Forever 21 has been taken to court by designer Trovata, for copyright infringement on certain design items originally produced by Trovata and replicated by Forever 21. The lawyers on both camps are at it this week, with Trovata arguing that this is intellectual property infringement while Forever 21 argues that there is no trademark infringement and no specific law on this issue….Well by the look of the picture below, it looks like Forever 21 has taken it a little far and if I was Trovata, I would do the same. Clearly their items look exactly like the Trovata tops…. But if designers today are becoming more conscious about the economy and the people that actually want to wear their clothes but can not afford them, then perhaps Forever 21 has a better social position…the clothes are cheap, they can look good a lot of the time, they may not last long but for a minute people are able to look “good” and replicate the latest fashion and runway trends. Not everyone can afford a $170 simple cardigan… In my opinion, Trovata needs to let it go or maybe if they made items that actually look like they should cost almost $200, they would not feel so threatened by Forever 21…. So what your take on this?? (See NYMag for full story)
